Din 26 august, 295 de producători au primit MDO pentru peste 1.089.000 de produse.De la data limită de 9 septembrie pentru eliminarea produselor neautorizate de pe piață, Centrul pentru produse din tutun FDA nu a autorizat niciun produs pentru țigări electronice pentru comercializare. Produsele respinse de PMTA ar trebui să fie eliminate de pe piață sau să facă obiectul aplicării ulterioare de către FDA.FDA a declarat că prioritățile sale principale de aplicare includ produse care au primit MDO sau care nu au fost niciodată trimise pentru revizuire.Cu toate acestea, toate produsele disponibile în prezent sunt încă supuse din punct de vedere tehnic la discreția de aplicare a FDA, inclusiv cele ale producătorilor de țigări electronice de pe piața de masă, cum ar fi Juul Labs și marca Vuse de la Reynolds American.
